WEBSITE TERMS OF USE

These Terms of Use for the website located at https://www.molfar.institute (the “Website”) have been developed in compliance with the applicable law of Ukraine (including the Civil Code of Ukraine, the Law of Ukraine “On Protection of Personal Data,” the Law of Ukraine “On Electronic Commerce (E-Commerce),” the Law of Ukraine “On Consumer Rights Protection,” etc.) and regulate the relationship between Non-Governmental Organization “OSINT”, as the administrator of the Website, and any individual in terms of using the Website.

For the purpose of these Website Terms of Use, certain terms have the following meanings:

The Organization means Non-Governmental Organization “OSINT” with legal entity identification code 45618511 and registered address at 23 Mezhova St., Kyiv, 04123, e-mail: info@molfar.com, contact phone number: +380992785580. Upon acceptance of the offer, the Organization will act as the Seller (the service provider). 

The Website means the website located at https://www.molfar.institute, which is administered by the Organization and contains information about the Products and the Services, terms and conditions for purchasing, paying for, and delivering the Products and the Services, promotions, advertising and marketing activities, other general information, other mandatory information, in a graphic form and/or in a text form, and addressed to the public, on the basis of which any individual can make an informed choice and contact the Organization with the Offer to enter into a retail sales contract for the Products or the Services in compliance with these Terms of Use. 

The User means an adult, legally capable individual who accessed the Website and continues to use the Website in compliance with these Terms of Use.

The Offer means the User’s selection of an item from the list of the Products or the Services available on the Website by adding the Product selected by the User to the shopping cart or by filling out a sign up form, entering any further details required to place an order, and clicking the checkout button.

The Product means household goods, accessories, and other products and associated goods, information about which is available on the Website.

The Service means webinars, multimedia presentations, and other services deliverables, information about which is available on the Website.

The Law means the applicable law of Ukraine that may be applied to any legal relations related to and/or arising from the performance of the obligations under these Terms of Use.

By staying on the Website, the User accepts these Terms of Use and the procedure for submitting the Offer to the Organization (placing an order) and its acceptance by the Organization, and gives the Organization the User’s consent to the processing of any personal data provided by the User and other information that the User considers necessary to provide, or that is required to be provided by the Law, and also accepts liability for any unfair use of the Website.

It is implied by the Organization and/or the User that all actions on the Website, including the submission of the Offer, are intended to enter into the retail sales contract for the Products or the Services, for the purposes not related to business.

The Organization informs that the description of the Product or the Service available on the Website, including prices, may be changed. The final price is the price specified in the Organization’s acceptance sent in response to the User’s Offer.

Any information about the Product or the Services available on the Website is published, inter alia, based on technical and other information provided by the manufacturer. In case of any conflict between the information available on the Website and the one in the documents supplied by the manufacturer, the User should refer to the data contained in the documents supplied by the manufacturer. The Organization has the right to modify the information available on the Website at any time without prior notice to Users.   

The User is liable for the accuracy of any information that the User provides when submitting the Offer (placing an order), in which case the User automatically gives the Organization the User’s consent to the processing of the User’s personal data that additionally became or will become known as a result of the User’s Offer being accepted. 

The Organization does not verify the information provided by the User. All information provided by the User is accepted without any additional verification and serves as a basis for processing of documents.

The Organization may, at its sole discretion, modify these Website Terms of Use. The User is obliged to review the latest version of these Website Terms of Use regularly.

Any other terms and conditions, regulations, and agreements published on the Website apply in addition to these Terms of Use.

All information and materials available on the Website and/or received by the User in connection with the use of the Website (the Products or the Services), including, but not limited to, texts, images, videos, lectures, webinars, logos, sound tracks, interface, software, and other elements, constitute the Organization’s intellectual property and are protected by the law and international agreements.

All information and materials available on the Website and/or received by the User in connection with the use of the Website (the Products or the Services) belong to the Organization or other lawful holders of rights that duly licensed the Organization to use and distribute their information and materials.

Any information and materials available on the Website and/or received by the User in connection with the use of the Website (the Products or the Services) may only be used with the written permission of the Organization or the relevant holders of rights.

The User is prohibited from copying, reproducing, modifying, distributing, customizing, creating derivative works from, and performing any other actions with any information and materials available on the Website and/or received by the User in connection with the use of the Website (the Products or the Services) without the prior written permission of the Organization.

The User has the right to use the information and materials available on the Website and/or received by the User in connection with the use of the Website (the Products or the Services) solely for personal, non-commercial use. The User does not have any rights to the information and materials available on the Website and/or received by the User in connection with the use of the Website (the Products or the Services), except as expressly provided in these Website Terms of Use.

Video and audio recordings, graphic materials of webinars, lectures, or other materials purchased or received by the User through the Website may be viewed by the User only on the User’s personal devices for personal training. The User is prohibited from providing access to such materials to other persons or uploading such materials to third-party services.

If the User discovers any violations of intellectual property rights on the Website, the User is obliged to notify the Organization thereof using the contact information provided in Section 1 of these Website Terms of Use.

The User is obliged to use the Website in compliance with the applicable law of Ukraine and these Website Terms of Use. The User may be held legally liable for any violation by the User of these Website Terms of Use or the law of Ukraine.

By using the Website, the User acknowledges that the User has read and understood, and agrees to be bound by, these Website Terms of Use. Should these Terms of Use be violated, the Organization reserves the right to take appropriate actions, as provided by these Terms of Use and the law.

The User is prohibited from copying, distributing, publishing, modifying, or otherwise using any information and materials available on the Website and/or that became available to the User in connection with the User’s use of the Website (the Products or the Services), without the Organization’s prior written consent. Any violation of this prohibition may result in, among other things, termination of the User’s access to the Website, a demand to remove illegally distributed information and materials, and bringing the User to liability under the law of Ukraine.

The User is prohibited from using the Website for any illegal or unfair acts, such as using the Website for fraud, manipulating to gain unauthorized access to other Users’ systems or personal data, spreading viruses or malware, or carrying out hacker attacks, providing false information when signing in, or using other people’s data without authorization to do so. The User will be held liable for such actions under the applicable law of Ukraine.

The User is prohibited from any violation of the rights of other Users, in connection with any disclosure of their personal data, abuse of private information, or other forms of infringement of confidentiality.

The User is prohibited from using any automated tools (scripts, bots, or crawlers) to interact with the Website.

When using the Website, the User is obliged to comply with the applicable law of Ukraine. Any violation, including, but not limited to, any use of the Website to distribute illegal content, any distribution of materials containing pornography, propaganda of violence, discrimination, hatred or terrorism, and any violation of the rights of others, may result in bringing the User to administrative or criminal liability under the law of Ukraine.

The Organization is committed to ensure that the information and materials available on the Website are accurate and up-to-date, but provides no guarantee that such information is fully accurate, complete, or correct. The User uses the Website at the User’s own risk. The Organization is not liable for any loss, damage, or other negative consequences resulted from the use of the Website, except as provided by the applicable law of Ukraine. 

The Website is provided by the Organization on an “as is” and “as available” basis, without any warranties, either express or implied. The Organization does not warrant that the Website’s operation will be uninterrupted, secure, fast, or error-free. The information and materials available on the Website meet the User’s expectations or goals. Any defects in the Website’s operation will be eliminated.

The Organization does not warrant that the Website or its servers are free of viruses or other harmful components. Users must take measures to protect Users’ devices and information while using the Website.

The Organization is not liable for any damage arising from the use of or inability to use the Website, the cost of replacing services purchased through the Website, access to any data or information that Users receive through the Website, any action or inaction of others on the Website. 

Should there be any technical failure of the Website, the Website be unavailable, or there be any disruption in the operation of the Website, the Organization will not be liable for any loss or damage that may be incurred by the User in this regard.

The Website may contain links to third-party resources (websites, platforms, etc.). The Organization does not control and is not liable for the content, accuracy or safety of third-party resources, as well as the Organization is not liable for any loss that may result from any use of such resources. Any transition to third-party resources is carried out at the User’s own risk. The administration of the Website is not liable for privacy policies or actions of third-party resources. 

The Organization is not liable for the User’s action or inaction that may result in any violation of the rights or interests of others. Any claims related to the User’s violation of the rights or legitimate interests of others will be resolved by Users with no involvement of the Organization.

Any materials, information, or advice available on the Website are for informational purposes only. The Organization is not liable for any consequences that may result from the User’s use of such materials or information without consulting a specialist or without analyzing the situation thoroughly.

By using the Website, the User automatically agrees to these Website Terms of Use. If the User disagrees with any provision of these Website Terms of Use, the User is obliged to immediately stop using the Website.

The User’s continued access to or use of the Website (including any browsing activity, order placing or other interaction) constitutes the User’s agreement to these Terms of Use, which also applies to any updates of or modifications to these Terms of Use.

Any use of the Website’s functionality without signing up, including any access to publicly available sections of or content browsing on the Website, automatically constitutes the User’s agreement to these Website Terms of Use.

The Organization is entitled to modify these Website Terms of Use without prior notice to the User. Such modified Terms of Use become effective once published on the Website.

Any continued use of the Website after modifications to these Terms of Use automatically constitutes acceptance of such modifications.
